Terms of Service – Maryland BioDetection

Welcome to Maryland BioDetection (“Company,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website (mdbiodetection.com), communications channels (including SMS/MMS text messaging), and our indoor air quality, mold, asbestos, and environmental consulting services (collectively, the “Services”).
By using our website, submitting an inquiry form, or scheduling an inspection, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.
1. Eligibility & Authority
You must be at least 18 years of age to use our Services or request an inspection. If you are accessing or requesting Services on behalf of a company, landlord, property owner, or other legal entity, you represent and warrant that you have full legal authority to bind that entity to these Terms.
2. Independent Inspection & Scope of Services
Independent Inspector Standard: Maryland BioDetection is an independent testing and environmental consulting firm. We do not perform remediation, abatement, or cleanup contracting services. Our reports, testing, and recommendations are unbiased and based on visual site assessments, localized parameter screenings, and accredited third-party laboratory analysis.
Onsite Quotations: Quotes provided online, via email, or over the phone are estimates. Final service pricing depends on verified property layout, square footage, geographic location/travel, and the total number of bulk or air samples required to complete the assessment.
Visual Hazard Disclaimer: Asbestos, mold, bacteria, and other environmental hazards cannot be definitively identified through visual observation or photographs alone. Definitive confirmation requires professional sampling and laboratory testing.
3. Payment, Cancellations, and Report Delivery
Payment Terms: Payment for inspection and testing services is due in full upon completion of the onsite inspection unless otherwise agreed in writing prior to service. We accept major credit cards (Visa, MasterCard), checks, and cash.
Report Release: Formal written reports and laboratory analysis will be released to the client upon receipt of full payment.
Cancellations: We request at least 24 hours’ notice for cancellations or rescheduling of scheduled site visits.
4. SMS & Mobile Communications (A2P 10DLC Disclosure)
By providing your phone number and opting in to receive SMS/MMS communications from Maryland BioDetection via our website forms, phone inquiries, or paper intake forms, you consent to receive transactional and informational text messages.
Program Description: Text messages sent by Maryland BioDetection may include inspection scheduling confirmations, inspector arrival alerts, estimate updates, and service follow-ups.
Message Frequency: Message frequency varies based on your active service requests and appointments.
Cost Disclosure: Message and data rates may apply depending on your mobile carrier and plan.

Opt-Out Instructions (STOP): You can cancel or opt out of receiving SMS notifications at any time by replying STOP to any text message. After sending “STOP”, you will receive a confirmation message that you have been unsubscribed.
Mobile Information Privacy Safeguard
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors in support services, such as customer service or message delivery, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
5. Electronic Communications & Consent
By using our Services or contacting us online, you consent to receive electronic communications from us (including emails, SMS, and website notices). You agree that all agreements, notices, disclosures, and other communications provided to you electronically satisfy any legal requirement that such communications be in writing.
6. User Conduct & Acceptable Use
You agree not to use our website or communications channels to:
Provide false, inaccurate, or misleading property or contact information.
Transmit spam, unsolicited commercial communications, or malicious code.
Attempt to gain unauthorized access to our digital systems, servers, or user communications.
7. Intellectual Property Rights
All content on mdbiodetection.com—including text, photos, educational guides, branding, logos, graphics, and report formats—is the property of Maryland BioDetection or its licensors and is protected by applicable United States copyright, trademark, and intellectual property laws.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Maryland BioDetection, its owner, employees, and subcontractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of:
Your use of or inability to use our website or Services.
Delays or errors caused by third-party analytical laboratories.
Environmental hazards or hidden damage concealed behind permanent structures, walls, or inaccessible areas of a property at the time of inspection.
Our total aggregate liability for any claim arising out of our Services shall not exceed the total dollar amount paid by you to Maryland BioDetection for the specific inspection or service rendered.
9. Indemnification
You agree to defend, indemnify, and hold harmless Maryland BioDetection, its owner (Keith Oltman), employees, and contractors from and against any third-party claims, liabilities, damages, losses, and expenses (including reasonable attorney’s fees) arising out of or in any way connected with your breach of these Terms or your misrepresentation of property ownership/authority.
10. Governing Law & Dispute Resolution
These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of the State of Maryland, without giving effect to any conflict of law principles. Any legal suit, action, or proceeding shall be instituted exclusively in the state or federal courts located in Maryland.
11. Changes to Terms
We reserve the right to modify or update these Terms at any time. Changes will take effect immediately upon posting to mdbiodetection.com. Your continued use of our website or Services following the posting of revised Terms signifies your acceptance of the changes.
